I'm down to two after reading species accounts for most of the evening. Either the dusky shark or the night shark. The where suggests it's a dusky; so does my guess as to the depth/habitat being fished. But (and I can't be sure from the photo) it looks like it has green eyes, so my guess is

Scientific Name: Carcharhinus signatus
Common Name: Night Shark

A baby mako shark in brown color phase.

Just a shot here because that is one ambiguous looking shark. The ones I caught this weekend in NC were smaller but that looks like a Spinner Shark.
